The " lecoinmontagne.com " website offers for sale mountain furniture and decoration items, intended in particular for mountain homes.

This Privacy Policy describes, in accordance with Article 13 of the GDPR, how the personal data of the Site's Users is collected and processed by SAS ESPACES INTERIEURS, the operator of the Site, as well as Users' rights and the means of exercising them.

This Policy, as well as any amendment to it, is published on the Site and must be accepted by all Users when creating the Customer Account.

1. DEFINITIONS

For the purposes of this Policy, the following terms are defined as follows :

  • Customer : natural or legal person who has placed an Order on the Site
  • Order : purchase of one or more Products by the Customer on the Site
  • Customer Account : account created by the User in order to place orders on the Site
  • Personal Data (or " Data ") : the User's personal data, within the meaning of Article 4 of the GDPR, processed by Le Coin Montagne for the purposes set out in this Policy
  • LE COIN MONTAGNE : the company SAS ESPACES INTERIEURS, a simplified joint-stock company with share capital of 10,000 euros, registered with the Gap Trade and Companies Register (RCS) under number 482 466 117, with its registered office at 20 route de Briançon, 05240 La Salle les Alpes
  • Product : all types of products, in particular but without limitation furniture, tableware and decorative items, sold by Le Coin Montagne on the Site
  • Site : public website operated by LE COIN MONTAGNE, available at the address " lecoinmontagne.com "; or any other url address or extension held by LE COIN MONTAGNE
  • User : Visitor to the Site or Customer
  • Visitor : natural person who visits one or more pages of the Site without placing an Order

2. WHO IS THE DATA CONTROLLER ?

The data controller is the company SAS ESPACES INTERIEURS, a simplified joint-stock company with share capital of 10,000 euros, registered with the Gap Trade and Companies Register (RCS) under number 482 466 117, with its registered office at 20 route de Briançon, 05240 La Salle les Alpes

3. WHO ARE THE DATA SUBJECTS ?

The data subjects, as defined in Article 4 of the GDPR and covered by this Privacy Policy, are the Users, as defined in Article I.

4. WHAT TYPES OF PERSONAL DATA ARE PROCESSED ?

As part of the use of the Service, the following personal data of Users is processed by LE COIN MONTAGNE :

1. Customer Account creation data

  • Email address
  • Password
  • Surname
  • First name
  • Gender

2. Data required to fulfil the Order

  • Mobile phone number
  • Postal address
  • Valid bank card number

3. Data on the User's activity

  • Dates and times of Orders
  • Pages visited, duration of the visit, items clicked, bounce rate, etc.
  • Customer reviews of Products published on review sites or social networks, as well as the pseudonym used
  • Logs : date and time of connection to the Site, the User's IP address

4. User Support data

  • Messages sent to the User Support service, replies provided, and all exchanges with the Support service.

5. Contact data (via the contact form)

  • Email address
  • Type of request, and full text of the request

5. WHAT ARE THE PURPOSES OF DATA PROCESSING ?

We have decided to draw up a list of the purposes of processing, for each type of data processed under Article IV.

Customer Account creation data
  • Identification of the User
  • Creation of the Customer Account
  • Placing of Orders
  • Order tracking
  • Carrying out commercial prospecting activities
Data required to fulfil Orders
  • Payment of Orders
  • Delivery and delivery tracking,
  • Invoicing
  • Management of payment methods
  • Management of after-sales and warranty requests,
  • Refund of Orders in the event of exercising the right of withdrawal
Data on the User's activity
  • Publish verified Customer reviews and promote the quality of the service offered on the Site
  • Determine User profiles, based on the analysis of selected Products, and offer them Products suited to their preferences
  • Compile anonymised statistical data per Product on Users' purchasing behaviour, for the attention of the suppliers and distributors of these Products
  • Select customers to carry out studies on product quality, consumer surveys or satisfaction surveys
User support data
  • Handle Users' support requests regarding the operation of the Site
  • Ensure the proper functioning of the Site.
Contact data
  • Response to the User's request for information about the Site or the Products offered by LE COIN MONTAGNE
  • Marketing processing (sending of newsletters and commercial promotion emails)

6. WHAT ARE THE LEGAL BASES FOR THIS PROCESSING ?

Once again, we thought it would be clearer to present such a legal basis for each type of data processing.

Customer Account creation data
  • The User has consented to the processing
  • The processing is necessary for the performance of our contractual obligations to fulfil Orders
  • The processing of data for commercial prospecting purposes is based on Article L.34-5 of the French Postal and Electronic Communications Code
Data required to fulfil Orders
  • The processing is necessary for the performance of our contractual obligations, namely the fulfilment of Orders in accordance with our Terms and Conditions
Data on the User's activity
  • The processing of data meets our legitimate interest as it allows us to improve the performance of the Site
  • The processing of data meets our legitimate interest as it makes it possible to create User profiles, with a view to offering them Products according to their purchasing preferences
  • The processing of data meets our legitimate interest as it makes it possible to measure the Site's audience and sales statistics
Loyalty data
  • The User has consented to the processing
  • The processing is necessary for our legitimate interest, since this Data makes it possible to better understand the customer base, to build its loyalty, and to send it personalised offers
User support data
  • The processing is necessary for the performance of our contractual obligations,
  • The processing of data meets our legitimate interest (keeping the Site in operational condition).
Contact data
  • The processing is necessary for the performance of pre-contractual measures, namely, in this case, responding to requests for information about our products and services
  • The processing is in line with our legitimate interest (marketing processing)

7. HOW IS MY DATA PROTECTED ?

The Site is hosted in France by GANDI SAS, a Société par Actions Simplifiée with share capital of 630000 €, with its registered office at 63-65 boulevard Masséna Paris (75013) FRANCE (Siren 423 093 459 RCS PARIS)

A daily backup of the Data is carried out.

The machines and servers are secured: only LE COIN MONTAGNE's employees and subcontractors are allowed to connect.

Bank transactions are carried out by the payment module of the company Monético Paiement, a subsidiary of the Crédit Mutuel - CIC bank.

The company Le Coin Montagne has no access to the Customer's payment data.

8. HOW LONG IS MY DATA PROCESSED FOR ?

Customer Account creation data
  • The Customer Account is closed either (a) at any time by the User, or (b) after 2 years of inactivity, in the absence of a reply from the User within 30 days to LE COIN MONTAGNE's email regarding the retention of their Account
  • The data is no longer processed in the active database from the closure of the Customer Account, but may be processed for a period of 3 years from that closure or from the Customer's last Order (whichever is more recent), for marketing prospecting purposes, in accordance with the CNIL's guidelines on commercial management, unless the User objects
Data required to fulfil the Order
  • Until the end of the fulfilment of the Order, including the warranty period
  • The Data is kept for 5 years from the Order, in order to demonstrate the proper fulfilment of the Order by LE COIN MONTAGNE
Data on the User's activity
  • The Data is no longer processed in the active database from the closure of the Customer Account
  • Anonymised Data may continue to be used for internal or marketing purposes after anonymisation
Loyalty data
  • The Data is erased upon closure of the Customer Account.
User support data
  • The Data is kept for only 12 months, from the resolution of the incident
Contact data
  • The Data is kept for three years from the last contact, for marketing processing purposes

9. DO WE TRANSFER DATA TO THIRD PARTIES ?

In addition, reviews of the Products and the Site are transmitted to our verification provider ( Avis Vérifiés ), in order to validate the reviews before their publication on the Site .

The User may at any time object to the processing of some of their Data by third parties, by configuring their privacy settings in their Customer Account.

10. DO WE USE COOKIES ?

The list of cookies used by the Site is available in the cookie banner that appears on the User's first visit .

For information, the cookies used as of the date hereof are the following:

  • The functional cookies necessary for the operation of the Site (session cookies, language cookies, etc.)
  • Google Analytics for audience measurement
  • the third-party Facebook connection cookies for campaign tracking and the presentation of targeted advertising on the social network
  • Probance for tracking mailing campaigns
  • Avis Vérifiés for managing user reviews
  • Smartsupp for chat support

The User is free to refuse all non-necessary cookies, and to configure them in order to choose those they wish to keep.

The User's choices are kept for a maximum period of 13 months, unless the cookies are deleted from their device in the meantime.

11. WHAT ARE MY RIGHTS AND REMEDIES ?

1. The User's rights over personal data

As a User, you have the right to ask us for :

  • confirmation as to whether or not Data concerning you is being processed and, if necessary, access to that Data
  • the rectification or updating of Data concerning you that is inaccurate or incomplete
  • the erasure of your Data, under the conditions provided for in Article 17 of the GDPR : you can, for example, request that the Data of your Customer Account be deleted directly on the Site, which will end the processing of all personal data, subject to the exceptions provided for in section VIII
  • to organise the fate of your Data in the event of death (storage, deletion or communication to a designated person)
  • to object, under certain conditions, to the processing of your personal data.

2. How to exercise them

You can delete your Customer Account at any time directly on the Site, it being specified that certain Data will be kept by LE COIN MONTAGNE (see Article 8).

You can at any time object to the processing of your Data for commercial prospecting purposes by clicking on the unsubscribe link provided in our emails.

For any other request, please send us an email to the following address : info@lecoinmontagne.com indicating the subject of your request, and your name and surname.

We will reply as soon as possible, at the latest within the month following receipt of your request.
